5. Nature of Our Data

India Biz Data specializes exclusively in business information products, including B2B Company Databases, B2B Business Databases, and B2C Business Databases, intended for legitimate commercial purposes such as sales, marketing, B2B outreach, lead generation, recruitment, market research, business development, and business intelligence.

B2B Company Databases may include company profiles, company email addresses, company phone numbers, official website information, and other publicly available business information obtained from lawful business information sources. Where available, company records may be enriched with publicly available company email addresses collected from official company websites and other legitimate business sources. We do not intentionally collect, compile, or provide private, personal, or non-business email addresses.

B2B Business Databases and B2C Business Databases primarily contain publicly available business information, including business names, business categories, business addresses, websites (where available), and business phone numbers. These datasets do not ordinarily include business email addresses. Where a customer specifically requests business email addresses as part of a customized database, such information, where available, may be obtained only from publicly available business sources, including official business websites. We do not intentionally collect, compile, or provide private, personal, or non-business email addresses.

India Biz Data does not intentionally compile, collect, market, or sell employee personal information, consumer personal databases, student databases, residential contact databases, sensitive personal data, financial information, government-issued identification information, health information, or personal information intended for private or household use.

Customers are solely responsible for ensuring that their acquisition and use of purchased datasets complies with all applicable laws, regulations, and industry standards.

6. Data Source Transparency & Compilation Methodology

India Biz Data compiles, organizes, structures, cleans, verifies, enriches, and maintains business information obtained from lawful business information sources. Such sources may include publicly available business information, company websites, business directories, government records, regulatory filings, industry publications, commercially available business information sources, research, verification activities, and other legitimate business information sources.

Our B2B Company Databases may be enriched with publicly available company email addresses, company phone numbers, official website information, and other business information obtained from official company websites and other lawful business information sources. We do not intentionally collect, compile, or provide private, personal, or non-business email addresses.

Our B2B Business Databases and B2C Business Databases primarily contain publicly available business information, including business names, business categories, business addresses, websites (where available), and business phone numbers. Business email addresses are not ordinarily included in these datasets. Where a customer specifically requests business email addresses as part of a customized database, such information, where available, may be obtained only from publicly available business sources, including official business websites.

India Biz Data does not represent that it is the original creator or sole source of all underlying business information contained within any dataset. Our datasets represent structured compilations of business information collected, processed, verified, enriched, organized, and maintained for legitimate commercial purposes.

The compilation, structure, selection, arrangement, organization, enrichment, and presentation of information within our datasets constitute the intellectual property of India Biz Data, independent of the underlying source information.

7. Data Freshness & Update Disclaimer

Business information changes frequently due to employee movement, personnel changes, company closures, restructuring, mergers, acquisitions, rebranding, website updates, and operational changes beyond our knowledge or control.

While India Biz Data undertakes reasonable compilation, update, and verification efforts, no Dataset should be considered permanently current, complete, or continuously updated unless expressly stated otherwise in the relevant product description. The data currency of each product, where available, is indicated on the respective product page.

Customers are advised to use purchased Datasets promptly and to independently verify the currency of critical information before use.

8. Prohibited Data Requests

India Biz Data provides business information and professional contact data intended for legitimate commercial purposes only.

We do not sell, license, distribute, or provide:

• Consumer databases
• Student databases
• Personal residential contact databases
• Sensitive personal data
• Government-issued identity information
• Financial account information
• Medical or health-related records
• Any data prohibited under applicable law

Requests for such information will be rejected. India Biz Data reserves the right to decline, cancel, or refund any order that appears to seek data categories outside the scope of its legitimate commercial offerings.

9. License Grant

Subject to full compliance with these Terms, India Biz Data grants each purchasing customer a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use purchased Datasets solely for their own internal business purposes.

This License does not transfer any ownership rights, intellectual property rights, or proprietary interest in any Dataset, compilation, database structure, or related materials to the customer. All rights not expressly granted herein are reserved by India Biz Data.

10. Permitted Uses

Purchased Datasets may be used for the following legitimate business purposes:

• Sales prospecting and lead generation
• Business development and partnership identification
• Market research, competitive analysis, and business intelligence
• Recruitment, talent acquisition, and headhunting
• Supplier, vendor, and distributor identification
• Professional networking and B2B outreach
• Investment research and due diligence (subject to independent verification)

Customers are solely responsible for ensuring that their use of purchased data complies with all applicable laws and regulations, including without limitation the DPDP Act, 2023, and applicable anti-spam and marketing communication rules.

11. Prohibited Uses

Customers shall not, directly or indirectly:

• Use purchased data for any unlawful, fraudulent, deceptive, or unethical purpose.
• Engage in phishing, impersonation, identity fraud, spam, or any form of cybercrime using purchased data.
• Harass, threaten, abuse, or mislead any individual or organization using purchased data.
• Violate applicable anti-spam regulations, marketing communication laws, or the DPDP Act, 2023.
• Resell, redistribute, sublicense, share, publish, or commercially exploit purchased Datasets — in whole or in part — without prior written authorization from India Biz Data.
• Use automated tools, bots, scrapers, or other extraction mechanisms to harvest, copy, or replicate content from the Website.
• Attempt to reverse-engineer, decompile, or derive database structures from any product.
• Attempt unauthorized access to systems, accounts, or services.
• Use purchased data in ways that violate the privacy, dignity, or legal rights of individuals or organizations.

Any violation of these prohibitions may result in immediate termination of your License, suspension of access, and legal action where warranted.

12. Reseller & Redistribution Restrictions

Unless expressly authorized in a separate written agreement signed by an authorized representative of India Biz Data, customers may not, directly or indirectly:

• Resell, distribute, lease, license, sublicense, publish, or upload purchased Datasets to any third party, whether commercially or non-commercially.
• Include purchased Datasets — in whole or in part — within any product, service, application, tool, or platform made available to third parties.
• Transfer, assign, or share access to purchased Datasets with any individual or organization not covered by the original purchase.
• Use purchased Datasets to build, train, fine-tune, augment, validate, enrich, populate, or support any database, artificial intelligence model, machine learning system, large language model, neural network, automated decision-making tool, data product, or data service.

Any unauthorized resale, redistribution, or sharing of purchased Datasets constitutes a material breach of these Terms and may result in immediate termination of the License, suspension of access, and legal action for damages.

13. User Account Responsibilities

Customers are responsible for:

• Maintaining the confidentiality and security of their account credentials.
• All activities, transactions, and actions carried out under their account.
• Providing accurate, current, and complete information during registration and purchase.
• Notifying India Biz Data immediately of any suspected unauthorized access to their account.

India Biz Data shall not be liable for any losses arising from unauthorized account access resulting from a customer’s failure to maintain account security.

14. Customer Information Accuracy

Customers agree to provide accurate, current, and complete information when creating an account, placing an order, or communicating with India Biz Data.

India Biz Data reserves the right to suspend processing, withhold delivery, or cancel orders where customer-provided information appears incomplete, inaccurate, fraudulent, or misleading. In such cases, India Biz Data will make reasonable efforts to notify the customer.

Customers are responsible for keeping their account information up to date and for notifying India Biz Data promptly of any changes to their contact or billing details.

15. Payment, Delivery & Refunds

All purchases made through the Website are one-time digital purchases unless expressly stated otherwise. Prices, product specifications, available data fields, and product features are displayed on the relevant product pages and may be updated periodically without prior notice.

Purchased products are delivered electronically through download links, secure access methods, email delivery, customer account access, or other digital means following successful payment confirmation.

Customers are responsible for reviewing product descriptions, sample files, data field information, coverage details, and applicable policies before completing a purchase.

Due to the digital, downloadable, and non-returnable nature of our products, all sales are generally final once delivery has been completed.

Refund requests may be considered only in limited circumstances, including:

• Failure to deliver the purchased product within fourteen (14) days of successful payment where the delay is solely attributable to India Biz Data.
• Verified technical issues that materially prevent access to, download of, or reasonable use of the purchased product, and where such issues cannot be resolved within a reasonable period after notification.
• Duplicate payments, billing errors, or incorrect charges verified by India Biz Data.

Refunds will generally not be granted for reasons including, but not limited to:

• Change of mind after purchase.
• Failure to review product descriptions, specifications, sample data, or coverage information before purchase.
• Dissatisfaction with marketing performance, sales results, lead generation outcomes, recruitment outcomes, outreach response rates, conversion rates, or other business results.
• Customer software, hardware, or compatibility issues not caused by India Biz Data.
• Customer inability to use, process, analyze, import, export, integrate, or otherwise work with delivered data.
• Business, financial, legal, recruitment, marketing, investment, or commercial decisions made using purchased Datasets.
• Requests submitted after successful delivery and access to the purchased product unless a qualifying issue exists under this Section.

If you believe you are entitled to a refund, you must first contact our support team and provide sufficient information regarding the issue. India Biz Data is committed to reviewing legitimate concerns fairly, reasonably, and in good faith.

Customers agree to provide India Biz Data with a reasonable opportunity to investigate and resolve any billing, delivery, access, or technical issue before initiating a payment dispute, chargeback, or payment reversal through a financial institution, card issuer, bank, or payment provider.

Fraudulent, abusive, or unauthorized chargebacks may result in suspension or termination of customer accounts and may be contested using transaction records, delivery confirmations, download logs, account activity records, customer communications, access records, and other relevant evidence.

Where a refund is approved, the refund shall be processed to the original payment method used for the transaction. Refund processing times depend on the payment provider and financial institution but are generally completed within five (5) to ten (10) business days after approval.

All payments are processed through secure third-party payment service providers. India Biz Data does not directly store complete payment card information.

Additional refund terms, procedures, eligibility requirements, and exceptions may be specified in the Refund Policy published on the Website, which is incorporated into these Terms & Conditions by reference.

16. Chargeback & Payment Dispute Policy

Customers agree not to initiate payment disputes, chargebacks, or reversals with their bank, card issuer, or payment provider without first contacting India Biz Data and providing a reasonable opportunity — no less than fourteen (14) business days — to investigate and resolve the concern.

Fraudulent chargebacks or payment disputes initiated after successful digital delivery — where the customer has accessed, downloaded, or received the purchased product — may be contested using delivery records, download logs, transaction confirmations, account activity records, and customer communications.

Customers who initiate unauthorized chargebacks may have their accounts suspended or permanently terminated, and India Biz Data reserves the right to pursue recovery of disputed amounts and associated costs through available legal remedies.

17. Intellectual Property Rights

The Website and all its contents — including database structures, compilations, product descriptions, branding, logos, designs, text, graphics, and digital materials — are the exclusive intellectual property of India Biz Data and are protected under applicable Indian intellectual property laws, including the Copyright Act, 1957 and the Information Technology Act, 2000.

Customers are granted a limited License as described in Section 9. No other rights are granted. Unauthorized copying, reproduction, redistribution, publication, reverse engineering, or commercial exploitation of any Website content or purchased Datasets is strictly prohibited.

18. Customer Compliance Responsibility

Customers are solely and exclusively responsible for ensuring that their acquisition, storage, processing, sharing, communication, and use of purchased Datasets complies with all applicable laws, regulations, contractual obligations, and industry standards, including without limitation:

• The Digital Personal Data Protection Act, 2023 (DPDP Act)
• The Information Technology Act, 2000 and IT Amendment Act, 2008
• The Telecom Commercial Communications Customer Preference Regulations (TRAI TCCCPR)
• Consumer Protection Act, 2019
• Any applicable sector-specific regulations

India Biz Data does not provide legal, regulatory, compliance, tax, or professional advisory services. Customers are advised to seek independent professional counsel regarding their specific compliance obligations before using purchased Datasets.

19. Customer Data Retention Responsibilities

Customers who acquire Datasets that include professional contact information are responsible for:

• Retaining data only for as long as necessary for the stated legitimate business purpose.
• Honouring any opt-out, unsubscribe, or do-not-contact requests received from individuals in the Dataset.
• Implementing reasonable technical and organizational safeguards to protect purchased data from unauthorized access, disclosure, or misuse.
• Complying with applicable data minimization and retention obligations under the DPDP Act, 2023 and any other applicable regulations.

India Biz Data is not responsible for how customers store, process, retain, or use purchased Datasets following delivery.

20. Bulk Email & Marketing Compliance

Customers who use purchased Datasets for email marketing, telemarketing, SMS outreach, messaging campaigns, or any form of commercial communication are solely responsible for ensuring full compliance with all applicable laws, regulations, and industry standards, including without limitation:

• The Telecom Commercial Communications Customer Preference Regulations (TRAI TCCCPR)
• The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
• The Digital Personal Data Protection Act, 2023 (DPDP Act)
• Any applicable anti-spam, marketing consent, and opt-out regulations

India Biz Data neither authorizes, encourages, nor accepts responsibility for unsolicited commercial communications, spam, or outreach campaigns that violate applicable laws, regulations, or industry standards. Customers bear sole responsibility for obtaining any required consents and honouring all opt-out or do-not-contact requests.

21. No Legal Reliance

Datasets are provided for informational and commercial prospecting purposes only. Nothing in any Dataset, product, service, Website content, or communication from India Biz Data constitutes or should be relied upon as legal, financial, regulatory, compliance, investment, credit, employment verification, due diligence, or professional advice of any kind.

Customers must independently verify all information before making material business, financial, legal, investment, recruitment, compliance, or commercial decisions. India Biz Data expressly disclaims any liability arising from reliance on Datasets for purposes beyond commercial prospecting and business intelligence.

22. Audit & Compliance Cooperation

Where India Biz Data has reasonable grounds to suspect misuse, unlawful activity, or material violation of these Terms, India Biz Data reserves the right to request information from the customer regarding their use of purchased Datasets.

Customers agree to cooperate reasonably and in good faith with any such inquiry and to provide accurate information within a reasonable time of such request. Failure to cooperate may be treated as an admission of non-compliance and may result in suspension or permanent termination of access to the Website, Services, and purchased products.

India Biz Data retains the right to share relevant information with regulatory authorities, law enforcement agencies, or other competent bodies where required by law or where unlawful activity is reasonably suspected.

23. Data Accuracy & Independent Verification

India Biz Data undertakes reasonable efforts to compile, organize, verify, and maintain the quality and accuracy of its Datasets. However, business information is dynamic and may change due to personnel turnover, company restructuring, relocations, mergers, acquisitions, or other factors beyond our control.

Accordingly, India Biz Data does not warrant that Datasets are complete, accurate, current, or error-free at the time of use.

Customers are strongly advised to independently verify critical information before making significant business, financial, legal, recruitment, compliance, or commercial decisions based on purchased data.

24. Disclaimer of Warranties

All products, Datasets, services, Website content, and information are provided on an “as is” and “as available” basis, without any warranties of any kind.

To the fullest extent permitted by applicable law, India Biz Data expressly disclaims all warranties — whether express, implied, statutory, or otherwise — including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, data accuracy, completeness, availability, reliability, or expected business outcomes.

India Biz Data makes no representations or guarantees regarding:

• Lead generation success, response rates, or sales outcomes
• Recruitment results or talent acquisition success
• Marketing campaign performance or appointment generation
• Revenue generation, return on investment, or business growth
• Uninterrupted or error-free access to the Website or products

Business results depend on factors beyond our control and are the sole responsibility of the customer.

25. Limitation of Liability

To the fullest extent permitted by applicable law, India Biz Data shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages of any kind arising from or related to:

• Unauthorized access to customer accounts or purchased data

In all circumstances, India Biz Data’s maximum aggregate liability shall not exceed the total amount paid by the customer for the specific product giving rise to the claim.

26. Indemnification

You agree to indemnify, defend, and hold harmless India Biz Data and its owners, affiliates, employees, contractors, agents, and service providers from and against any and all claims, demands, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

27. Limitation Period for Claims

Termination does not entitle the customer to any refund unless explicitly provided under the Refund Policy.

33. Export Control & International Use

Customers accessing the Website or purchasing products from jurisdictions outside India are solely responsible for ensuring compliance with all applicable local laws, regulations, and restrictions in their respective jurisdictions, including data protection laws, marketing regulations, import restrictions, and any applicable export control regulations.

India Biz Data reserves the right to restrict access to or availability of its products and services in any jurisdiction at its sole discretion.

35. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or any Services provided, the parties shall first attempt resolution through good-faith negotiations within 30 days of written notice of the dispute.

If good-faith negotiations do not result in resolution, disputes shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India, as amended. The seat and venue of arbitration shall be Chennai, Tamil Nadu, India. Proceedings shall be conducted in English.

Nothing in this clause shall prevent either party from seeking urgent injunctive or other equitable relief from a competent court where necessary.

36. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to the Dispute Resolution clause above, any disputes not referred to arbitration shall be subject to the exclusive jurisdiction of the courts having competent jurisdiction in Chennai, Tamil Nadu, India.
